This policy provides an overview of the School Sport Victoria (SSV) appeals process for Team Vic selection.
Details
SSV provides a state representative team programme across a number of sports, enabling connections wherever possible to community participation pathways and State Sporting organisations.
SSV appoints a Selection Panel of Team Officials for each state sport representative team that can include coaches, assistant coaches, managers and other selectors who are responsible for selection decisions.
The SSV Team Vic manager is responsible for forming selection panels.
Selection panels are responsible for:
Designing trial selection guidelines for approval by the SSV Team Vic Manager, that allow for a performance, results-based assessment or any other factors for the selection of students;
Developing and implementing trial and selection processes for the sport they are the panel for
Determining provisional and final team selections
Wherever possible the relevant state sporting organisation provides staff and sport-specific expertise to assist team officials with team selection.
This policy may be updated from time to time by SSV and provided on the SSV website (https://www.ssv.vic.edu.au).
An appeal may be made by a student and their family who have participated in a trial for a School Sport Victoria team.
An appeal can only be made on the grounds that the selection process was not followed as per the published trial and selection process (i.e. a procedural error). An appeal cannot be made on the merits of a student being selected or not selected.
Requests for feedback on a student's performance at a trial will not be provided.
Where a family believes that a procedural error has occurred, they must first attempt to resolve the matter with the SSV Team Vic Manager. If the matter is not resolved, an appeal can be lodged in accordance with this Policy.
Grounds of Appeal
The only grounds of appeal are that the selection process was not followed.
The following are not grounds of appeal:
a challenge to the merits of the selection decision (i.e. why one student was selected over another)
a challenge to the selection criteria or the trial process itself.
Appeals Process
A student/family wishing to appeal must do so within 48 hours of the provisional team being announced on the SSV website.
The appeal must be in writing and submitted to the SSV CEO at school.sport.victoria@education.vic.gov.au (mailto:school.sport.victoria@education.vic.gov.au).
The appeal must include a letter of support from the student's School Principal.
The appeal must clearly state the grounds on which the appeal is being made and provide evidence of the procedural error.
An appeal fee of $50.00 must be paid to SSV at the time of lodging the appeal. This fee will be refunded if the appeal is successful.
Appeals Committee
The SSV CEO (or delegate) will appoint an Appeals Committee to consider the appeal. The Appeals Committee will consist of three people who were not involved in the original selection decision.
The Appeals Committee may consist of SSV staff, Department of Education staff or representatives from a State Sporting Organisation.
The Appeals Committee will:
Review the written appeal and any other relevant information.
Request further information from the student/family, the selection panel and/or the SSV Team Vic Manager (or their delegate).
Determine if the appeal warrants further review.
Decision of the Appeals Committee
The Appeals Committee shall, as soon as practical after receiving the appeal information, consider the matter and shall within 7 days of receiving such information, determine whether the matter:
should be dismissed, because in its determination, the matter is trifling in nature or has no merit; or
warrants further review and determination in accordance with this Policy.
The Appeals Committee may conduct a meeting convened in any such manner as it sees fit, giving due consideration to any written statement by the appealing party or any other person party to the Appeal.
Following consideration of all relevant and available information, the Appeals Committee shall arrive at a finding. A decision of the Appeals Committee may be by a majority decision.
The Appeals Committee shall notify the SSV CEO (or Nominee) of its finding as soon as practicable.
If the Appeals Committee considers the grounds alleged by the Appellant to be satisfied, it shall recommend and where required, direct that the Selection Panel again consider the selection/nomination to the relevant Team.
The Selection Panel shall comply with any direction of the Appeals Committee in this regard.
Any further selection decision of the Selection Panel under the direction of the Appeals Committee shall be final, and no other further appeal shall be available to the Appellant in respect of that selection.
